The natural or legal person who purchases online the art object\/Painting presented by the SELLER, hereinafter referred to as the BUYER, have agreed to conclude this sale-purchase contract under the conditions below:<\/p>
2.1. The object of the contract is the online sale by the SELLER of the paintings presented on the website https:\/\/georgiana-art.eu to the BUYER.<\/p>
3.1. The prices of the paintings are those displayed on the website for each individual painting. For the BUYER from Romania, the prices are displayed in RON, and for the BUYER from a member country of the European Union, the prices are displayed in EURO.
3.2. The prices for Romania do NOT include VAT because T\u00e2rb\u0103 Georgiana PFA is VAT non-paying.
3.3. Prices for European Union BUYER include Romanian VAT. If the EU BUYER is a VAT payer in the country from which the order is placed, please contact the SELLER to prepare the invoice without VAT, based on the Conventions for the avoidance of double taxation.
3.2. Payment can be made online, by card and is paid in full at the time of placing the order. When completing the order, the shipping cost to the BUYER’s location will be displayed, a cost that will be included in the payment.
3.3. The tax invoice will be issued on the date of debiting the amount to the SELLER’s account (according to the account statement).<\/p>
4.1 To order the products, the buyer will fill out an order form on the store’s web page. The order formcontains information in particular about:<\/p>
4.2 The seller, without delay, after receiving the order, will confirm its receipt to the buyer by e-mail, to the buyer’s e-mail address entered in the order.
4.3 The legal relationship between the seller and the buyer is established by the transmission of the acceptance of the order, which is sent by the seller to the buyer by electronic mail to the e-mail address communicated by the buyer.
4.4. By completing the order, the buyer agrees that the seller can contact him, by any means available \/ agreed by the Seller, in any situation in which it is necessary to contact the buyer.
4.5. If a product ordered and paid for by the buyer cannot be delivered by the seller, the latter will inform the buyer of this fact and will return to the buyer’s account the counter value of the product, within a maximum of 7 (seven) days from the date on which the seller became aware of this fact.
4.6. By placing an order, the buyer agrees with the Terms and Conditions, Privacy Policy and Cookies Policy of the website www.georgiana-art.eu<\/p>
5.1.Under EU law, when purchasing a product or service online, you have the right to cancel your order within 14 days, for any reason and without any justification.
5.2. Important! Returned products must not show signs of use, scratches or any signs of destruction.
5.3. Return shipping will be fully borne by the BUYER.<\/p>
6.1. The seller ensures the solution of buyers’ complaints through the contact address (georgiana-art@gmail.com). Information regarding the resolution of the buyer’s complaint, the seller will send it to the buyer’s email address.
6.2. For the amicable settlement of buyers’ disputes arising from the sale-purchase contract, the court at the SELLER’s headquarters is competent, according to the Code of Civil Procedure.
6.3. The buyer hereby assumes the risk of changing circumstances\/circumstances within the meaning of art. 1271 paragraph 3 Civil Code.<\/p>
7.1. The protection of personal data of the buyer, who is a natural person, is provided by law no. 677\/2001, regarding the protection of personal data, with subsequent amendments and additions.
7.2. The buyer agrees to the processing of his personal data: name and surname, home address, unique identification code, fiscal identification code, e-mail address and telephone number (hereinafter all together as “personal data” ).
7.3. The buyer agrees with the processing of personal data by the seller, for the purpose of realizing the rights and obligations arising from the sale-purchase contract and for the purpose of managing the user account.
7.4. To process the buyer’s personal data, the seller can authorize a third party as a processor. In addition to the persons transporting the goods, personal data will not be communicated by the seller to third parties without the prior consent of the buyer.<\/p>
8.1. None of the Parties is responsible for the non-execution on time and\/or for the improper execution – in whole or in part – of any obligation falling under this contract, if the non-execution or improper
execution of the respective obligation was caused by force majeure, as is defined by law.
8.2. The party invoking force majeure is obliged to notify the other party within 5 (five) days of the occurrence of the event and to take all possible measures to limit its consequences.
8.3. If, within 10 (ten) days from the occurrence of the respective event, the respective event does not cease, the parties have the right to notify the termination of the present contact without any of them claiming damages.<\/p>
9.1. If the relationship based on the sale-purchase contract includes international (foreign) elements, then the parties agree that the relationship is governed by Romanian law. This does not affect the buyer’s rights resulting from the general binding legislation.
9.2. In the event that any provision of the terms and conditions is not valid or in force, or becomes so, instead of the provisions that are not valid, there will be the provisions whose meaning is closest to the invalid provisions. The invalidity of one provision does not affect the validity of the other provisions.
9.3 Any communication between the parties regarding these terms and conditions can be sent by e-mail or letter, according to the legal provisions in force.<\/p>
